These Terms of Service (“Terms”) govern your access to and use of the websites, forms, communications, and related services operated by NERA Response LLC (“NERA,” “we,” “us,” “our”). By using our site or submitting information through any NERA form, you agree to these Terms.
NERA is a coordination, marketing, and dispatch platform that helps connect property owners/occupants and referral partners with independent third-party contractors for property damage-related services.
NERA does not perform restoration, remediation, mitigation, construction, plumbing, environmental, or contracting services, and is not a general contractor, insurer, public adjuster, or claims handler. Any services are provided solely by independent contractors.
Contractors are independent entities and are not employees, agents, partners, or representatives of NERA. NERA does not supervise, direct, or control contractor work, pricing, materials, permitting, scheduling, safety practices, or workmanship. Any agreement for services is solely between you and the contractor.
NERA does not guarantee: (a) contractor availability; (b) response times; (c) pricing; (d) insurance coverage or claim outcomes; (e) job results; or (f) that any contractor will accept a referral. Dispatch and routing may fail or be delayed due to technical limitations, coverage gaps, high demand, weather events, or other factors.
When you submit a request or referral, you authorize NERA to route the information you provide to one or more independent contractors for the purpose of coordinating services.
Consent to contact: By submitting your information, you consent to being contacted by NERA and/or independent contractors via phone call, SMS/text message, and email regarding your request or referral. Standard message/data rates may apply. You may opt out of SMS communications by replying STOP.
The NERA name, branding, site content, and materials are owned by NERA or its licensors and may not be copied, modified, distributed, or used without permission, except as allowed by law.
NERA provides its website and coordination services on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, NERA disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, NERA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of the platform or any contractor services.
To the maximum extent permitted by law, NERA’s total liability for any claim related to the platform will not exceed the amount you paid NERA in the 30 days before the event giving rise to the claim, or $100 if you paid nothing.
You agree to indemnify and hold harmless NERA from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the platform, your violation of these Terms, or your interactions with contractors.
These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Rhode Island, and you consent to jurisdiction and venue there.
We may update these Terms from time to time. The “Effective Date” above indicates when they were last revised. Your continued use of the platform after changes constitutes acceptance of the updated Terms.

Important: If any part of these Terms is found unenforceable, the remaining provisions remain in effect.
